Cancellation and Refund Conditions

SECTION 1 — B2C POLICY (DIRECT CONSUMER SALES)

(Applies to reservations purchased directly via TAKK Travel website, sales office, social media channels or direct communication.)


1. Contract Formation

Upon completion of the reservation, the Consumer receives a Voucher containing booking details. The Package Tour Agreement attached to or referenced within the Voucher constitutes the legally binding contract between the Consumer and TAKK Travel (Konit Turizm A.Ş.).

By completing payment, the Consumer confirms acceptance of:

  • Package Tour Agreement
  • Cancellation & Refund Policy
  • Service conditions of third-party providers

2. Promotional & Campaign Tours

Promotional or campaign tours are offered under special pricing conditions and may be subject to stricter cancellation terms. Refunds are not available except where mandatory rights arise under applicable consumer protection legislation or force majeure provisions.


3. Cancellation Conditions

Cancellation requests must be submitted in writing via e-mail or official communication channels.

3.1 International Package Tours

Unless otherwise specified:

Non-refundable items may include:

  • issued flight tickets

3.2 Cruise Tours

Unless otherwise stated:

Cruise operator policies may override standard tour cancellation terms.

4. Transportation Services (Airline / Train / Cruise Tickets)

Transportation services included in package tours are operated by independent carrier companies.

  • Tickets are issued in the name of the Consumer.
  • Carrier fare rules apply to cancellations, changes and refunds.
  • Airline, train or cruise penalties may apply regardless of tour cancellation date.

TAKK Travel acts as package organizer but transportation services remain subject to international carrier regulations.

Even in force majeure situations, carrier-imposed deductions may apply where refunds cannot be recovered from the provider.


5. Name Change & Transfer Rights

Package tours may be transferred to another participant under the following conditions:

  • International Tours → free until 30 days before departure
  • Domestic Tours → free until 30 days before departure
  • Daily Tours → free until 15 days before departure

After these deadlines:

  • supplier approval may be required,
  • additional costs may arise,
  • some services may not allow changes.

All change requests must be confirmed in writing.

Visa fees completed for the original passenger are non-refundable and non-transferable.


6. Visa, Insurance & Ancillary Services

The following services are non-refundable once processed:

  • visa applications
  • insurance policies
  • domestic connection flights
  • embassy or governmental fees

Visa approval responsibility belongs to the traveler.


7. Force Majeure & Health-Related Cancellation

Force majeure includes:

  • death
  • serious illness
  • major accident
  • legally documented unavoidable events affecting the traveler or first-degree relatives

Official documentation from authorized institutions is required.

In such cases:

  • refundable amounts are returned,
  • non-recoverable third-party costs are deducted,
  • refunds are processed within 14 business days after confirmation.

Insurance policies may cover additional reimbursement depending on insurer procedures.


8. Tour Cancellation by TAKK Travel

TAKK Travel reserves the right to cancel tours due to:

  • insufficient participation
  • safety concerns
  • weather conditions
  • operational or force majeure reasons

Notification periods:

  • International tours → minimum 5 days
  • Domestic tours → minimum 2 days
  • Daily tours → minimum 1 day

Full payment will be refunded within 14 business days.

No additional compensation obligation arises.


9. Refund Processing & Credit Card Payments

Refunds are issued using the original payment method.

Bank processing times may vary and may take up to 14 business days after refund initiation.

Consumers are encouraged to contact TAKK Travel directly for resolution before initiating any bank dispute procedure.

 

SECTION 2 — B2B POLICY (AGENCY & PARTNER SALES)

(Applies to intermediary travel agencies, resellers, corporate partners and contracted sales representatives.)


1. Contractual Relationship

In B2B sales:

  • The contracting party is the Partner Agency.
  • The Agency is responsible for informing the end consumer of all cancellation conditions.
  • Acceptance of reservation constitutes acceptance of TAKK Travel operational terms.

2. Reservation Responsibility

Partner agencies must:

  • transmit correct passenger data,
  • obtain consumer approvals,
  • ensure acceptance of package tour terms.

Errors caused by agency submission remain the responsibility of the Partner Agency.


3. Final Name List & Non-Cancellable Reservations

For tours where the Final Name List has been officially submitted and confirmed by the Partner Agency:

  • The reservation becomes final and irrevocable.
  • Such reservations cannot be cancelled.
  • No refund request may be submitted or claimed after the final passenger list has been confirmed.

The Partner Agency accepts that operational commitments, supplier allocations, transportation services and contractual obligations are finalized upon submission of the Final Name List.


4. Official Communication Channel

For all operational, financial and contractual matters between TAKK Travel and the Partner Agency:

  • Only communications submitted via official e-mail correspondence shall be considered valid, binding and legally effective.

Notifications, approvals, requests or information shared through:

  • telephone conversations,
  • messaging applications,
  • social media platforms,
  • verbal communication,
  • SMS or similar channels

shall not be considered official communication and shall not create any contractual obligation unless subsequently confirmed via official e-mail.

Cancellation Requests

All cancellation requests must be submitted exclusively through official e-mail communication.

The date and time of receipt of the cancellation request by TAKK Travel’s official e-mail system shall be deemed the official notification date and shall constitute the sole basis for:

  • calculation of cancellation deadlines,
  • application of cancellation penalties,
  • determination of refund eligibility.

Requests transmitted through other communication channels shall not be accepted as valid cancellation notices.


5. Cancellation Rules

Unless otherwise agreed in a commercial contract:

  • B2B reservations follow B2C cancellation timelines.
  • Any cancellation penalties charged by TAKK Travel are invoiced to the Partner Agency.

Agency commission becomes non-payable once cancellation penalties apply.


6. Transportation Services

Airline, cruise and other carrier penalties apply identically to B2C bookings.

TAKK Travel cannot override carrier fare rules.

Partner agencies must clearly inform travelers that transportation services are governed by provider regulations.


7. Name Changes & Transfers

Name changes requested through agencies must be submitted in writing via official e-mail communication.

All supplier-imposed costs are transferred to the agency account.


8. Payment & Refund Settlement

Refunds in B2B bookings are processed only to the Partner Agency, not directly to the traveler.

The Partner Agency assumes responsibility for onward settlement with the end customer.


9. Force Majeure Cases

Force majeure refund evaluations are performed by TAKK Travel.

Approved refunds are issued to the Partner Agency after deduction of non-recoverable supplier costs.


10. Liability Limitation

TAKK Travel acts as organizer of the package tour.

Partner Agencies act as independent sellers and are responsible for:

  • consumer communication,
  • pre-contractual information,
  • local legal compliance.

11. Operational Cut-Off & Supplier Commitment

In order to ensure the operational execution of package tours, TAKK Travel enters into binding commitments with airlines, hotels, cruise operators, destination management companies, transportation providers and other third-party suppliers prior to tour departure.

11.1 Operational Cut-Off Date

Each tour is subject to an Operational Cut-Off Date, determined by TAKK Travel based on supplier deadlines and operational requirements.

As of the Operational Cut-Off Date:

  • all services are considered operationally confirmed,
  • supplier commitments become financially binding,
  • inventory allocations and guaranteed payments are finalized.

The Operational Cut-Off Date may differ for each tour and shall be communicated to the Partner Agency via official e-mail.


11.2 Effect of Operational Cut-Off

After the Operational Cut-Off Date:

  • cancellations,
  • passenger reductions,
  • service downgrades,
  • unused allotments,
  • payment withdrawals

shall not release the Partner Agency from its financial obligations.

The Partner Agency remains responsible for all confirmed services and committed costs.


11.3 Supplier Non-Recoverable Costs

Where TAKK Travel has already fulfilled financial commitments toward suppliers, any amount that cannot be recovered from:

  • airlines,
  • hotels,
  • cruise companies,
  • local operators,
  • transportation providers

shall be fully chargeable to the Partner Agency.


11.4 Minimum Participation & Allotment Protection

For group departures organized based on minimum participation or blocked inventory:

  • reduction below confirmed passenger numbers after Operational Cut-Off shall not constitute valid cancellation,
  • contracted group pricing remains applicable,
  • TAKK Travel reserves the right to invoice the difference arising from unused capacity.

11.5 Operational Authority

TAKK Travel reserves the right, where operational necessity requires, to:

  • adjust flight schedules,
  • change suppliers with equivalent standards,
  • reorganize logistics,
  • modify routing or timing

without altering the essential nature of the package tour.

Such operational adjustments shall not constitute grounds for cancellation or compensation claims.

12. Confirmation by Silence (Deemed Acceptance)

In order to ensure operational efficiency and timely execution of tour services, TAKK Travel may communicate operational updates, confirmations, deadlines, payment reminders, passenger information requests, service modifications or other tour-related notices to the Partner Agency via official e-mail communication.

Unless otherwise explicitly stated:

  • the Partner Agency shall review such communications promptly,
  • any objection, correction or rejection must be submitted in writing via official e-mail.

If the Partner Agency does not submit a written objection within 24 hours following the delivery of the relevant e-mail notification, the communicated information shall be deemed:

  • reviewed,
  • accepted,
  • confirmed by the Partner Agency.

Such deemed acceptance shall be considered contractually binding and operationally valid.


Operational Changes Covered Under This Clause

This provision applies, including but not limited to:

  • passenger list confirmations,
  • operational deadlines,
  • rooming lists,
  • flight schedule updates,
  • supplier changes of equivalent category,
  • payment reminders,
  • tour timing adjustments,
  • documentation requests.

Limitation

This clause shall not eliminate statutory consumer rights but regulates operational coordination between TAKK Travel and the Partner Agency.

13. Publication & Official Notice

TAKK Travel is not obliged to individually deliver, send or re-transmit the Cancellation & Refund Policy to Consumers or Partner Agencies via e-mail, messaging platforms or any other communication channel.

The most current version of the Cancellation & Refund Policy published on the official TAKK Travel website shall constitute the official announcement and legally valid notification.

All parties who:

  • purchase services from TAKK Travel (B2C), or
  • cooperate, resell, distribute or operate tours in partnership with TAKK Travel (B2B)

are deemed to have:

  • accessed,
  • reviewed,
  • understood,
  • and accepted

the Cancellation & Refund Policy as published on the official website at the time of reservation or contractual engagement.

Failure to review the published policy shall not invalidate its applicability.

TAKK Travel reserves the right to update, amend or revise the Cancellation & Refund Policy when operational, legal or commercial conditions require. Updated versions become effective as of their publication date on the official website.

14. Entire Agreement & Hierarchy of Documents

This Cancellation & Refund Policy forms an integral part of the contractual framework governing all services provided by TAKK Travel.

Together with the following documents, it constitutes the entire agreement between TAKK Travel and the Consumer and/or Partner Agency:

  • Package Tour Agreement
  • Voucher and booking confirmation
  • Official TAKK Travel website publications
  • Commercial agreements executed with Partner Agencies (if applicable)
  • Operational confirmations issued via official e-mail communication

No verbal statements, informal communications, promotional representations, social media correspondence or prior discussions shall modify, replace or override these contractual documents unless expressly confirmed in writing by TAKK Travel.


Hierarchy of Documents

In the event of any conflict, discrepancy or interpretation difference between documents, the following order of precedence shall apply:

  1. Mandatory applicable laws and tourism regulations
  2. Signed commercial agreements between TAKK Travel and Partner Agency (if applicable)
  3. Package Tour Agreement
  4. Official Cancellation & Refund Policy published on the TAKK Travel website
  5. Voucher / Booking Confirmation
  6. Operational notices and confirmations sent via official e-mail

The higher-ranked document shall prevail over lower-ranked documents.


Non-Waiver

Failure by TAKK Travel at any time to enforce any provision shall not be interpreted as a waiver of its rights or as acceptance of any deviation from the contractual terms.
